Enhancement on the civil, administrative judgment enforcement in the province

Chairman of the Provincial People's Committee has just sent a written request
to the heads of specialized agencies under the Provincial People's Committee; Chairpersons
of district-level People's Committees to strengthen the civil and
administrative judgment enforcement in the province.
Accordingly, the
Chairman of the Provincial People's Committee assigned the Provincial Civil
Judgment Enforcement Department (the Standing Agency of the Provincial Steering
Committee for Civil Judgment Enforcement) to continue to direct the Civil
Judgment Enforcement Sub-Departments and the enforcers of the Provincial Civil
Judgment Enforcement Department to regularly review and supplement cases that
have been sold at the auctions but not yet been delivered the properties, and
new important and complicated cases arise.
For the backlog and
complicated key judgment enforcement cases that are underway, the Provincial
Civil Judgment Enforcement Department must take the initiative in formulating
the detailed execution plans for each case. Coordinating well and effectively
with the Departments and agencies to take measures to remove obstacles and
difficulties related to legal issues or mechanisms and policies on land; at the
same time, well applying the mechanism of mobilizing and persuading involved
parties to voluntarily execute the judgments. In case the involved parties are
sufficient for judgment execution but not voluntary, then resolutely applying
the measures of coercive judgment enforcement according to regulations.
The Chairman of the
Provincial People's Committee also requested the Departments and agencies to
coordinate closely with the Provincial Civil Judgment Enforcement Department
and the Civil Judgment Enforcement Sub-Departments in all aspects of civil
judgment enforcement. At the same time, requested the local Steering Committees
for Civil Judgment Enforcement to focus on directing the coordination in
organizing the enforcement of judgments, especially the coercive handing over
of assets sold at auction; definitively settling the high-value and complicated
key cases affecting political security, social order and safety in the
locality; strictly handling cases of delay or evasion of judgments. Paying
attention to the consideration in issuing documents requesting civil judgment
enforcement agencies to postpone the coercive judgment enforcement, the
postponement of judgment enforcement must be conducted in compliance with the
provisions of law.
